CONTRACTORS PLANT 2ND FEBRUARY 2023

THIS SECTION IS FOR RING 3 ONLY

Generators, Site mixers, Pumps, Compressors, Rollers, Reversing Plates, Dumpers, Excavators, Hydraulic breakers, Forklifts, Access & Telehandlers, Vehicles, Engines, Attachments.

This auction will be open for registration and bidding from 8am on Friday 27th January 2023.

This auction will be run online only with a closing date of 12 noon on Thursday 2nd February 2023.

The closing time of each batch of 12 lots will be staggered by 1 minute. If a bid is made on any lot during the final 5 minutes the bidding time of that lot will automatically be extended for a further five minutes.

For those who do not or cannot register to bid online or do not have the hardware to do so, we are happy to exercise commission bids on your behalf, providing you have inspected the goods in question.

The auctioneers reserve the right to take a £2,000 deposit from all bidders on registering for this auction. Refunds of deposits to unsuccessful bidders will be instigated by the auctioneers within 48 hours of the sale closing, however, some banks take up to 5 working days to process refunds.

The Auctioneers cannot be held responsible for bank charges or any deficit in deposit refunds as a result of currency fluctuations.

Sign ups for this auction are provisional and subject to the approval of the auctioneer who will notify bidders by email.

There will be buyers premium of 3% (+VAT) (minimum £10.00 +VAT per lot) added to the hammer price of all lots, with the exception of some motor vehicles. please check the catalogue for variations.    Attachments will carry a buyers’ premium of 10% plus VAT (minimum £2.50 + VAT per lot).

VAT : Each lot will state if VAT is to be added to the hammer price. VAT invoices will be issued.

We will continue to be as upfront as we can be regarding the working conditions of machines.

UNLESS SPECIFICALLY REQUESTED NO INVOICES WILL BE ISSUED UNTIL RING 2 HAS CONCLUDED ON FRIDAY 3rd FEBRUARY.   No sale is confirmed until an invoice has been issued.

Payment: Our terms are strictly bank transfer.

Bank details will be found on your invoice. Our bank details have not changed – if you are in any doubt please call prior to transferring large amounts of money.

Cash payment via your bank is not permitted. The Auctioneers will only accept payment from and permit removal of goods purchased by the successful purchased or their duly appointed agent. No lots will be transferred to third party invoices after the auction.

Removal of goods: All lots remain at the risk of the purchaser from the fall of the hammer. Payment should be made immediately and goods removed within 14 days failing which storage charges may be levied. The few days immediately following the auction are always extremely busy and in order to avoid long waiting times it may be advisable to call us before arriving to collect. We will have staff available from 8am until 4pm on the day following the auction and on weekdays thereafter.

DESCRIPTIONS: No liability whatsoever is undertaken in respect of faults, deficiencies and errors of description either oral or printed. ALL LOTS ARE SOLD AS SEEN WITHOUT WARRANTY and are available for inspection prior to sale, all lots are sold on the understanding that they may be suitable for spares or repair only. We strongly recommend that you view before bidding.

Please note that bidding at auction constitutes an irrevocable and binding agreement to purchase. We recommend that you carefully examine any items you intend to bid on as refunds will not be given for Buyer’s Remorse

Any lifting equipment is sold on the understanding that it does not have any current LOLER certificates or similar and purchasers are responsible for testing prior to use.

Please note hour and kilometre readings are those shown on the machine when accepted into the auction site. They cannot be relied upon in the event that the clock is broken or a new clock has been fitted. No warranty is given either expressly or implied whatsoever. If in doubt purchasers are advised to make their own independent enquiries as to the correctness of such information before purchasing.

EU CONFORMITY – Purchasers must satisfy themselves as to the suitability of equipment for export markets and the auctioneers accept no liability in any respect whatsoever. Certificates of Conformity are not supplied with equipment but in most cases will be available from the manufacturer.

OVERSEAS PURCHASERS

We will do our utmost to assist with the new post Brexit export regulations. We are aware that the new requirement for customs declarations when purchasing goods from our UK sales and exporting to the EU is complex. All export buyers must contact us prior to purchasing to clarify what extra information you will require. We will provide our EORI number on all export invoices and can arrange customs declarations at cost. We are working with a Customs Clearance Agents who will assist us with relevant declarations to enable equipment to leave England. The purchaser is responsible for all transportation from there onwards.

Should ensure that the country of destination has no import or currency restrictions on the goods you wish to purchase. Our normal terms of business otherwise apply and payment is due in full on the day of sale. Please note that all new overseas customers will be required to pay a VAT deposit.

CONDITIONS OF SALE FOR ON-LINE AUCTIONS & TENDERS

1. 1. At the fall of the hammer, closing of the tender sale or the on-line lot closing time, the highest acceptable bid for each lot shall be the Purchaser and, in the event of any dispute, the Auctioneers shall have absolute discretion to settle such dispute.
2. 2. All lots are put up for sale subject to any reserve price placed by the Vendors
3. 3. All intending bidders at on-line or tender sales must register with the Auctioneers prior to placing a bid. All intending bidders must make prior arrangements regarding method of payment before attending or participating in a sale.
4. 4. No lot or lots shall be removed from the premises until paid for, but each and every lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk of the respective Purchaser or Purchasers thereof, and shall be removed at the Purchaser's expense after the conclusion of the Sale and taken with all faults or errors of description.
5. 5. The Auctioneers act only as agents for the Vendor(s) and are not responsible for any default by either Vendor(s) or Purchaser. In particular, they shall not be liable to pay the Vendor until payment is received from the Purchaser.
6. 6. No undertaking of the Auctioneers or their employees to take charge of any lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of the foregoing conditions.
7. 7. In all cases of transfer the original Purchaser shall be held responsible for the purchase money.
8. 8. The Auctioneers have described the lots to the best of their ability and belief, but any statement made either in advertisements, catalogues, on-line description, photograph or other publicity are those of opinion only and are made without responsibility and shall not give rise to any action in law for damages or compensation or rescission of sale by a purchaser against the Vendor, the Auctioneers or their employees. All electrical or mechanical items are sold as un-tested, without warranties or any guarantees as to serviceability, working order or fit for purpose.
9. 9. Many lots offered for sale on-line are by reason of age or nature, not in first class condition. Some descriptions may refer to damage or restoration but the omission of such a statement does not imply that a lot may be free of damage or has been restored. Therefore all purchasers must satisfy themselves by physical inspection prior to making a bid as to the origin, authenticity, quality, quantity, weight, size and general description of each lot as all lots are sold “as seen” with all faults whether declared or not.
10. 10. The Auctioneers accept no responsibility in connection with the commissioning of their staff to bid for any lots. Reserves and commissions given verbally or by telephone are accepted at the sender's risk and must be confirmed in writing before the Sale.
11. 11. THIRD PARTY LIABILITY. All persons attending the sale or viewing whether it be at the Auctioneers’ premises or other place, before, during or after the Sale shall be deemed to be at their own risk and with notice of the condition of the premises and of the method of arranging lots and shall have no claim against the Auctioneers nor their principals in respect of any injury or accident which may occur from any cause whatsoever including postponement or cancellation of the sale.
12. 12. If any Purchaser shall fail to comply with the above conditions or any of them, the Auctioneers shall be at liberty to recover in full the amount of the purchase money of the lot or lots bought by such Purchaser together with all interest, costs, charges and expenses, without reference to any delivery or acceptance of the lot or lots, other than the first delivery by the fall of the hammer, or to resell any lot or lots bought by such Purchasers, either by public or private sale, and the full amount of the purchase money at the present sale, or the deficiency (if any) arising from the second sale, together with all interest, costs, charges and expenses, shall be made good by the defaulter and be recoverable as and for liquidated damages.
